DECAPITATED's Attorney Blasts Kidnapping Charges: "There Is Another Side To This"

The attorney claims the band has witnesses that dispute the kidnapping story.

The attorney claims the band has witnesses that dispute the kidnapping story.

Earlier today, we were informed that Decapitated had been arrested in Santa Ana, California on the night of September 8 regarding an alleged kidnapping which took place on August 31 in Spokane, Washington. The Spokesman-Review, who originally reported the charges, has now published a statement from Decapitated's attorney, Steve Graham.

Graham says there's another side to the story, and that Decapitated has originally offered to surrender after they heard of the charges, "but never heard anything back."

“Defense attorney Steve Graham of Spokane said he was hired by the band on Thursday after they became aware of the investigation.

“There is another side to this,’ he said. ‘We have witnesses that can testify to the fact that the accuser came to visit band of her own free will and left on good terms.’

“He said he told police that the band members had offered to surrender but never heard anything back. ‘I made it clear that I could get the guys up here ASAP and they would cooperate,’ he said.

“Graham said he’s concerned that they will ‘languish’ in the Los Angeles County Jail for weeks before being returned to Spokane, but said the four will not fight extradition and will return to Spokane willingly.”

We'll keep you posted. As of right now, all four members of Decapitated are currently sitting the Los Angeles County Jail awaiting extradition to Spokane.  In Spokane, punishment for class A felony is imprisonment for twenty years or more and for class B felony is eight years or more. Bail is currently set at $100,000.
